Article 2 – Applicability
These Terms and Conditions apply to all offers made by Maxi Goose and to all distance contracts concluded between Maxi Goose and the consumer via the website.
Any deviations from these Terms and Conditions are only valid if expressly agreed upon in writing.
Article 3 – The Offer
All products are clearly described on the website.
Obvious errors or mistakes do not bind Maxi Goose.
Information regarding prices, shipping costs, and delivery times is always included in the offer.
Article 4 – The Agreement
A contract is concluded once the customer places an order and payment has been successfully received.
The customer will receive an order confirmation by email without delay.
Article 5 – Prices
All prices are listed in Canadian Dollars (CAD) and include applicable taxes, unless stated otherwise.
Prices exclude any import duties, customs fees, or similar charges that may be imposed upon delivery.
Shipping costs are clearly displayed during checkout.
Free shipping applies to orders over $120 CAD within Canada.
Article 6 – Payment
Payment must be made using one of the payment methods available on the website.
Orders will only be processed after full payment has been received.
Article 7 – Shipping and Delivery
Orders placed before 10:00 PM (EST) are processed within 2–3 business days.
The estimated delivery time is 7–10 business days, depending on the delivery location.
Delivery is carried out by recognized shipping partners and includes tracking information.
Products may be shipped directly from suppliers located outside Canada.
Article 8 – Right of Withdrawal (Returns)
Customers have the right to withdraw from their purchase within 14 days of delivery, without stating a reason.
Returned items must comply with our Return Policy.
Personalized or custom-made products are excluded from the right of withdrawal, unless defective or incorrectly delivered.
Article 9 – Returns
Return requests must be submitted by email within 14 days of receiving the order.
Returns within Canada are free of charge, provided return conditions are met.
Only unused, unworn items in original condition and packaging are eligible for return.
Article 10 – Warranty and Product Conformity
Maxi Goose guarantees that delivered products conform to the agreement and meet reasonable standards of quality and usability.
If a product is defective or incorrectly delivered, the customer must contact us promptly so we can provide an appropriate solution.
Article 11 – Liability
Maxi Goose is not liable for indirect or consequential damages.
Damage incurred during shipping is only our responsibility in cases of demonstrable negligence.
Article 12 – Complaints Procedure
Complaints can be submitted via email at support@maxigoose.com.
We aim to provide a substantive response within 14 days.
Consumers may also submit complaints to the appropriate consumer protection authority in their province or territory.
Article 13 – Force Majeure
Maxi Goose is not liable for failure to fulfill obligations due to force majeure, including but not limited to natural disasters, pandemics, wars, government measures, labour disputes, or transportation delays.
Article 14 – Governing Law
These Terms and Conditions and all related agreements are governed by the laws of the Netherlands, unless mandatory consumer protection laws in Canada provide otherwise.
Any disputes shall be submitted to the competent court in the Netherlands.
Article 15 – Shipping from Outside Canada
Maxi Goose may ship products directly from suppliers located outside Canada.
Maxi Goose does not handle customs clearance or import processing.
Article 16 – Customs Delays and Liability
Maxi Goose is not responsible for delays caused by customs authorities or carriers.
Any delays, inspections, or administrative handling are beyond our control.
Article 17 – Import Duties, Taxes, and Customs Fees
Upon delivery, additional charges such as import duties, taxes, or brokerage fees may apply.
These charges are entirely the responsibility of the customer.
Article 18 – Customs Risk
Maxi Goose has no influence over customs policies or procedures.
The risk of delay, refusal, seizure, or additional charges lies solely with the customer.
Article 19 – Partial Invalidity
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
The invalid provision will be replaced by a valid provision that most closely reflects the original intent.
